Abstract. The purpose of the current paper was to determine the legal status of the Maritime Doctrine of the Russian Federation as a source of maritime law and to substantiate the possibility to classify it as an independent legal form of a source of law. The methodological basis comprises formal-legal, system-structural, and comparative-legal methods, as well as methods of analysis and synthesis of regulatory material and scientific concepts. There have been studied the main doctrinal approaches to understanding legal doctrine (conceptual, authoritative, normative, policy-oriented, and differentiating) and analyzed the legal nature of the Maritime Doctrine of the Russian Federation. The result of the study is the author’s definition of a source of law as the volitional activity of a subject aimed to objectify a system of legal forms, that makes it possible to overcome the limitations of the positivist concept. There has been substantiated that the Maritime Doctrine possesses such characteristics of a source of law as certainty of content, recognition by relevant subjects, binding force, and external expression. There has been concluded that the official (state) doctrine effectively functions as a source of law, necessitating the formalization of its status within the hierarchy of legal sources.
Keywords: legal doctrine; strategic planning; maritime law; regulatory legal act; law enforcement.
