UDK: 342.5

DOI: https://doi.org/10.30932/2500-1868-2026-59-3-10

Timofey T. Pronin - Researcher of the Security Problems Studies Center of RAS, Moscow, Russia

Abstract. The current paper has considered proactive law-making in the constituent entities of the Russian Federation regarding matters of joint jurisdiction between the Russian Federation and its constituent entities. There have been analyzed laws adopted proactively by these entities in specific areas of public security, such as ensuring fire safety, crime prevention, and countering extremist activity. There have been identified the ways to bring such legislative acts into conformity with federal laws adopted subsequently. There has been drawn a conclusion regarding the positive effect of the experience of proactive law-making on the further development of legislation in some constituent entities of the Russian Federation and on the legal framework for regional security as a whole, as well as regarding the decline of proactive law-making, the possibility of which has persisted following the reform of public authority. There have been analyzed current trends regarding proactive law-making in the constituent entities of the Russian Federation. According to the author, this practice also holds potential for ensuring regional security in the future if new security threats emerge.

The current paper has been prepared as part of the implementation of the state assignment “Comprehensive study of public security issues as a strategic priority of national security of the Russian Federation (FFFZ-2025-0001)”.

Oksana An. Kolotkina. Concept of the Federal Law “On Public Security in the Russian Federation”: necessity, place in the legislation, and scientific-methodological foundations

UDK: 342

DOI: https://doi.org/10.30932/2500-1868-2026-59-3-09

Oksana An. Kolotkina - Candidate of Law, Associate Professor, Ural State University of Economics, Senior Researcher of the Security Problems Studies Center of RAS, Ekaterinburg, Moscow, Russia

Abstract. The current paper has substantiated the necessity to adopt a federal law “On Public Security in the Russian Federation”. There has been shown that the current legal regulation is fragmentary in nature, the valid period of the 2013 Concept of Public Security in the Russian Federation has effectively expired, and there is no foundational legislative act in this sphere. There have been analyzed the views of scholars regarding the necessity of enacting this law, as well as the main issues of academic debate concerning its conceptual and categorical framework and the form of its legislative embodiment. There has been proposed an original concept of a federal law, including legalization of robust concepts of public security; a framework law with the elements of direct applicability; a coordination mechanism based on the Security Council of the Russian Federation; the integration of non-state actors into public security enforcement; measures to counter digital challenges and threats; and regional dimension and structure of law. There have been made the conclusions regarding the necessity to develop and subsequently adopt this legislative act.

The current paper has been prepared as part of the implementation of the state assignment “Comprehensive study of public security issues as a strategic priority of national security of the Russian Federation (FFFZ-2025-0001)”.

Mariya V. Goncharova. Recruitment of Russian Federation citizens into subversive and terrorist activities as a threat to national security

UDK: 342

DOI: https://doi.org/10.30932/2500-1868-2026-59-3-07

Mariya V. Goncharova - Doctor of Law, Associate Professor, Main Researcher of the RC No.1, National Research Institute of the Ministry of Interior of the Russian Federation, Moscow, Russia

Abstract. Statistical data from the Main Information and Analytical Center of the Russian Interior Ministry regarding terrorist-related crimes, including the recruitment of Russian citizens into subversive and terrorist activities, for the period from 2021 through the first half of 2026 indicate a rise in negative trends within this segment of the crimes, notwithstanding all measures taken by law enforcement agencies. A definite increase in the involvement of Russian Federation citizens into subversive and terrorist activities has occurred during the special military operation in Ukraine. This situation indicates that the issue poses a significant threat to national security. The solution of the problem requires a study of the criminological characteristics of these crimes, the findings of which can serve as a foundation to improve preventive measures. The current paper has identified the criminological characteristics understanding of which is necessary to enhance the efficiency of preventing the recruitment of Russian Federation citizens into subversive and terrorist activities. They include the state and dynamics of terrorist-related crimes, the factors determining such crimes, methods, target audiences, and the ways used to recruit Russian citizens into subversive and terrorist activities. There has been concluded that negative trends regarding the recruitment of citizens into subversive and terrorist activities are likely to persist in the future. It is highly probable that the pool of individuals drawn into such crimes will expand to include citizens facing increasingly difficult economic conditions. Such problem will necessitate the enhancement of preventive measures not only at the specialized criminological and general social levels but also at the victimological level.

DOI: https://doi.org/10.30932/2500-1868-2026-59-3-06

Kirill V. Alekseev - Candidate of Philological Sciences, Associate Professor, Associate Professor of the Department of Literature and Journalism, Faculty of Russian Philology and National Culture, Ryazan State University named after S. Yesenin, Senior Researcher of the Security Problems Studies Center of RAS, Ryazan, Moscow, Russia

Abstract. The current paper has presented the study of the objects of public security and entities to ensure it. Due to the analysis, there have been identified specific characteristics of these objects and entities within the sphere under consideration. As a result, there have been concluded that certain objects of public security and the entities responsible for ensuring it are characterized by the fact that they can simultaneously serve as both objects and active agents. There can be different extent of participation by various entities in ensuring public security. The primary goal of ensuring any type or subtype of security is to achieve a state of protection for the fundamental objects—the individual and society. In terms of its objects, public security possesses the most complex structure among the three categories of national security. The system of entities ensuring public security comprises the state, local self-government, and civil society. Civil society institutions and citizens may participate in ensuring public security either with or without a special legal status. The effectiveness of ensuring public security depends, inter alia, on the active participation of civil society institutions and citizens and the extent to which they are supported by state legal guarantees. There is a necessity in an up-to-date strategic planning document and a dedicated law on public security.

The current paper has been prepared as part of the implementation of the state assignment “Comprehensive study of public security issues as a strategic priority of national security of the Russian Federation (FFFZ-2025-0001)”.

Elmira N. Kharina - Candidate of Law, Associate Professor, Associate Professor of the Department of Criminal Law, Criminal Procedure, and Law Enforcement Activity, Law Institute, Russian University of Transport (MIIT), Moscow, Russia

Abstract. The current paper has considered the special aspects of the legal regulation of labor performed by convicted persons at transport infrastructure facilities, against the expanding practice of imposing non-custodial sentences. The purpose of the study was to identify the legal factors determining the possibility to engage convicted persons into work within the transport sector, as well as to assess the balance between the objectives of their resocialization and transport security requirements. The methodological framework of the current study comprises formal-legal, systemic-legal, comparative-legal, and interdisciplinary research methods, enabling to analyze the norms of the Russian Federation’s penal enforcement, labor, and transport legislation. There has been found that the feasibility of employing convicted persons at transport infrastructure facilities is determined not only by their criminal-law status but also by the specific legal regime governing particular facilities, the nature of the work performed, and the scope of requirements imposed on personnel regarding transport security. There has been concluded that the current model of legal regulation fails to fully account for the category of the convict, the nature of the crime committed, and the extent to which the work performed could impact the safety of the transport system. There has been also an argument for a more differentiated approach to restricting convicts’ access to work at transport infrastructure facilities, based on the principles of individualizing the execution of sentences and enforcing transport security. The study results could be applied in both legislative and law-enforcement activities, including the development of mechanisms for the labor-based rehabilitation of convicts.
