UDK: 346.7+656.01

Viktoriya Al. Kavyrshina - Candidate of Economic Sciences, senior researcher of the Department of Economic Security Issues’ Study, Economic Research Institute, Donetsk, Russia

Abstract. The current work is of great relevance as there is a lack of sufficient structuring of the theory of security in modern Russian science. The purpose was to study the state of normative legal regulation of transport complex security, the logic of its formation, its placement in the system of economic security, as well as identification of the essence of economic security associated with the transport sector. The current paper has analyzed the definitions of various types of security used in the practice of normative legal regulation of security, as well as attempts to systematize them. The analysis has shown that legislative and other normative legal regulation is developing in the directions of existing threats. There is no protection against economic threats in the sphere of transport complex regulation. In order to solve problems of economic security, there have been used strategies and forecasts of socio-economic development, state programs. In the current Strategy of Economic Security of the Russian Federation, there are no specific indicators of the state of economic security for transport. The analysis of scientific literature has shown that at the current stage of development, the understanding of the essence of economic security is still being formed, and that the key concept is “sustainable development” of the country and its regions. Economic security enforcement is associated with the development of an effective mechanism that ensures timely recognition of threats to sustainable economic development, prevention of dangerous conditions or minimization of consequences. There has been concluded that it is advisable to develop a system to counteract economic threats associated with the functioning of transport, for which purpose there has been introduced the concept of “economic security in the transport sector”. There have been defined the threats to economic security in the transport sector. The goal of economic security management in the transport sector is to ensure uninterrupted supply of the economy with the necessary volume of resources requiring transferring at the lowest possible rates. There have been developed the main elements of the mechanism for enforcing economic security in the transport sector. They can become the basis for specialized normative and legal regulation.

Sergey Iv. Gir’ko, Aleksandr Al. Dolgopolov. Current issues of national security of the Russian Federation

UDK: 351.74

Sergey Iv. Gir’ko - Doctor of Law, professor, Head, Main Researcher, Security Research Center of the Russian Academy of Sciences, Research Institute of the Federal Penitentiary Service of Russia, honored scientist of the Russian Federation, Moscow, Russia

Aleksandr Al. Dolgopolov - Doctor of Law, associate professor, Professor of the Criminal law Department, Kuban State Agrarian University, Krasnodar, Russia

Abstract. In the current paper there have been hypothetically formed the most relevant areas of ensuring national security from the authors’ point of view, based on modern approaches to the problems of ensuring national interests, strategic priorities defined by the National Security Strategy of the Russian Federation and the practice of covering in special sources priority areas of scientific research that specify and reveal the deep content of national priorities. There have been highlighted such issues as problems of legal regulation of state, public and transport security, the situation with the education of a harmonious personality of a citizen of the Russian Federation. The relevance of the problem is in the fact that in the current realities of the Russian Federation, the intensification of hostile actions and intentions towards the state from external and internal forces, the growth of challenges and threats to national security, state security enforcement represents confrontation with external factors, as well as public security, namely the neutralization of internal challenges and threats. The clarity and sufficiency of the legal support for the named strategic priorities has a direct impact on the efficiency of the actions of entities to neutralize harmful factors, the choice of specific means of their neutralization depending on the nature of the challenges and threats themselves. The purpose of the current study was to analyze, within the scope of the paper, the state of legal regulation and provision of such national strategic priorities as enforcing state security and ensuring public safety, transport security, a set of national interests that together form the priority task of state bodies and society as a whole, namely the education of a harmonious personality, the formation of a modern citizen of Russia, the required criteria that it must meet. Based on the conducted research, there has been concluded that state security, as a strategic national priority, neither in Soviet times had nor in modern Russia has legal regulation in the legislation of the RF, which creates obstacles to the perception of the said legal institution. Public safety, on the contrary, until 2020 had a basic legal act of the President of the RF, the Concept of Public Safety of the Russian Federation, which has lost its legal force, and transport security has had a special federal law that needs to be specified. At present, it is also necessary to develop a legislative act that enshrines the basic legal provisions of public safety as a legal institution and regulates the main state approaches to its regulation. The same legislative act may reflect the “basic” problems of transport security, as a state of protection of society and man in the conditions of a multi-aspect transport complex. The named priorities will require efforts of the scientific community to develop modern theoretical problems and legal regulation in legislative acts of the state. The education of a harmonious personality is a priority area defined by the President of Russia, which should also attract active participation of the scientific community and government agencies in order to develop theoretical problems and form legal regulations for comprehensive approaches to solve this problem.

Vladimir N. Safonov. The value and safety of human life in the context of criminal-legal casuistry and common sense (based on judicial practice in transport)

UDK: 343.3/.7

Vladimir N. Safonov - Candidate of Law, Associate Professor, Associate Professor of the Department of Criminal Law of the North-West Branch, University of Justice named after V. M. Lebedev, federal judge (retired), Saint-Petersburg, Russia

Abstract. In the context of significant losses of human lives that modern Russian society suffers in the sphere of transport, there has been set the goal to study their real protection in the designated area. From the standpoint of a dialectical approach to the content and essence of any social phenomenon, the author addresses the problematic aspects of responsibility for causing death to a person while driving a vehicle. According to various research methods (systemic, logical, comparative and, in fact, legal), there has been analyzed the modern regulatory framework in terms of transport crimes, materials of judicial practice and the latest most relevant publications devoted to the study of crimes in the field of driving vehicles. Based on the analysis of judicial practice, in particular, the Resolution of the Plenum of the Supreme Court of the RF of December 9, 2008 No. 25 “On judicial practice in cases of crimes related to the violation of traffic rules and the operation of vehicles, as well as their illegal seizure without the intent to steal”, and procedural decisions of lower courts of the Russian Federation, there has been determined an unjustified expansion of the judicial approach to the classification of causing death to victims, when this is related to the actual driving of vehicles by a guilty party, not according to the special norms of Chapter 27 of the CC of the RF, but according to a more lenient general norm (Article 109 of the CC of the RF). There have concluded about the inefficiency of criminal-legal protection of human life in the sphere of transport due to such a qualification approach of the law enforcement officer and, as a consequence, through symbolic punishment, which entails “devaluation” of a human life as an object of criminal-legal protection and its ineffective protection. There has been proposed a change in judicial approaches to the qualification of such crimes.

Iliya S. Krylov. Other public transport as a place of committing a crime, according to the paragraph “c” of Part 1 of Article 213 of the Criminal Code of the Russian Federation

UDK: 343.343.3

Iliya S. Krylov - Deputy Head of the Department for Investigation Organization and Application of Administrative Legislation, Main Directorate for Transport of the Ministry of Internal Affairs of the Russian Federation, Moscow, Russia

Abstract. The current paper has analyzed the legal and organizational foundations of the activities of other public transport, determining the specifics of the place and circumstances of the commission of crimes, according to the paragraph “c” of Part 1 of Article 213 of the CC of the RF. According to the generalization of the provisions of regulatory legal acts in the field of transport, there has been presented a normatively substantiated list of types of other public transport, their classification, types of rolling stock, which are important for the purposes of qualifying hooliganism committed on various types of transport. There has been focused the complex structure of passenger transport enterprises and a wide range of regulatory legal acts governing their activities, the specifics of types, composition and structural elements, as well as their applicability in criminal law. There has been separately identified the problem of the lack of a unified understanding of the content of the concepts of “transport” and “vehicle” in criminal law literature. There has been provided an analysis of research works, the purpose of which was to attempt to develop universal criteria for the conceptual apparatus applicable to criminal law. The research part of the work has presented the arguments that the rolling stock of this group of public transport should include buses, trams, trolleybuses, electric buses, subway cars, monorails, cable cars or funiculars, which are intended for the implementation of passenger transportation in the mode of urban or off-street public transport. In order to visualize the conclusions, there has been enclosed a schematic list of other public transport, which can be used in law enforcement activities to qualify the acts provided for in the paragraph “c” of Part 1 of Article 213 of the Criminal Code of the Russian Federation, committed on other public transport.

Igor N. Dorofeev, Alina An. Prokudina. Urgent legal regulation issues of the use of unmanned transport in the railway industry

UDK: 629.053

Igor N. Dorofeev - Candidate of Law, Associate Professor, Associate Professor of the Department of Legal Support of National Security The Russian Presidential Academy of National Economy and Public Administration (RANEPA), Moscow, Russia

Alina An. Prokudina - Institute of Law and National Security, The Russian Presidential Academy of National Economy and Public Administration (RANEPA), Moscow, Russia

Abstract. The current paper has considered the urgent issues of implementing autopilot systems in rail transport in the context of creating special legal regimes, as well as implementing tools used in risk management. The specifics of using these mechanisms became the subjects of the current study. There has been paid attention to the current legal acts defining the status of artificial intelligence systems, as well as the rules for its use in freight and passenger transportation using the example of the work of JSC “Russian Railways”. There have been considered various levels of automation of the rolling stock of the train, as well as the role of the locomotive crew in monitoring the operation of the train equipped with an autopilot system. There has been concluded that the use of artificial intelligence systems in rail transport is still “conditional” in nature, since control over the choice of certain decisions made by an autopiloted vehicle is carried out by a person. In the context of legal support for the process of using unmanned vehicles in the railway industry, it is important to implement the “risk compliance” method, based on the development and implementation of local (internal) regulations, compliance with legislation and the prevention of various risks and threats, which is an extremely urgent issue in the context of real, potential and probable risks in the industry, as well as the introduction of risk-oriented approach methods when organizing the work of employees with systems equipped with artificial intelligence.

Olga S. Glozman, Sergey Al. Lirnik. On the necessity to amend regulatory legal acts on the requirements for recording storage locations for short-term rental vehicles (car sharing)

UDK: 347.453.6

Olga S. Glozman - Candidate of Technical Sciences, Associate Professor, Russian University of Transport (MIIT), Advisor to the Russian Academy of Architecture and Construction Sciences, Moscow, Russia

Sergey Al. Lirnik - Russian University of Transport (MIIT), Moscow, Russia

Abstract. The current paper has presented the study results of the modern phenomenon of car sharing. The first part has provided a detailed historical analysis of approaches to determining the number of vehicle storage locations in regulatory legal acts (codes of practice). Then there have been given the results of the analysis of statistical data recording the decline in motorization in some regions of Russia and revealing the ratio of cars of individual owners and car sharing. There has been substantiated the necessity to take into account the new type of individual public transport in transport law. In order to obtain quantitative indicators of the use of carsharing, there have been conducted two large-scale field studies as part of an educational program by students at the Higher Engineering School of the Russian University of Transport. The studies of traffic intensity and the percentage of parked carsharing cars in the city streets made it possible to formulate the basic principles for calculating the required number of storage spaces for short-term rental cars.
